Heard Mr. Virendra Kumar Jaiswal, learned counsel for the applicants, learned A.G.A. representing the State.
This application under Section 482 Cr.P.C. has been filed by the applicants to quash the charge-sheet dated 17.09.2022 and proceedings of Criminal Case No. 255 of 2023 (State Vs. Sandeep and others) arising out of Case Crime No. 404 of 2022, under Sections 147, 323, 352, 504 IPC, Police Station Khoda, District Ghaziabad pending in the court of Vth Additional Chief Judicial Magistrate, Ghaziabad.
At the outset, learned counsel for the applicants submits that on account of some defects in the application, the applicants do not want to press this application, therefore, the same may be dismissed as withdrawn with liberty to file fresh application with better particulars.
Learned A.G.A. representing the State has no objection to such prayer of learned counsel for the applicants.
In view of the statement made by Mr. Virendra Kumar Jaiswal, learned counsel for the applicants at the bar, the instant application is dismissed as withdrawn with liberty as prayed for.
OfÏce is directed to return certified copy of the documents, if any, after retaining the xerox copy of the same, to learned counsel for the applicants within ten days.
