This application under Section 482 Cr.P.C. has been filed by the applicant to quash the impugned order dated 15.04.2023 passed by Additional Sessions Judge/Special Judge, POCSO Act (First), Gautam Budh Nagar in Session Trial No. 505 of 2021 (State Vs. Rajeev Kumar) arising out of Case Crime No. 0634 of 2020, under Sections 420, 328, 376, 384, 504, 506 IPC and Section 67A of Information Technology (Amendment) Act, Police Station Noida Sector 39, District Gautam Budh Nagar and also to allow the application under Section 231(1) Cr.P.C. to adduce additional evidence moved by the applicant.
At the outset, learned counsel for the applicant submits that Investigating OfÏcer has collected pendrive from the victim/applicant and further investigation in the matter is going on, therefore, the applicant does not want to press this application and she may be allowed to withdraw this application.
Learned A.G.A. representing the State and learned counsel for opposite party no. 2 have no objection to the submission made on behalf of the applicant.
In view of the statement made by Mr. Shreesh Srivastava, learned counsel for the applicant at the bar, instant application is dismissed as withdrawn.
