Perused the record.
This application under Section 482 Cr.P.C. has been filed challenging the impugned order dated 4.10.2021 passed by Additional Civil Judge, Room No.20, Deoria in Complaint Case No.2096 of 2019 (Chandradev Vs. Dinanath Prasad and others), under Section 323 I.P.C., P.S. Kotwali, District-Deoria as well as entire proceedings of aforementioned complaint case now pending in the Court of Additional Civil Judge, Room No.20, Deoria.
After some arguments, the learned counsel for the applicants wants to withdrawn this application with liberty to file a bail application before the court of competent jurisdiction.
In view of the above, the application is disposed of as withdrawn with liberty to the applicants to appear before court below and file an appropriate application for bail, which shall be decided in the light of decision rendered in Satender Kumar Antil Vs. Central Bureau of Investigation and another, Special Leave to Appeal (Crl.) No (s) 5191 of 2021 decided on 07.10.2021, if there is no other legal impediment.
