The applicant has come up with a prayer to quash the entire proceedings of S.S.T. No. 69 of 2009, Kripal Singh vs. Jayram and others, under Section 392 IPC, P.S. Bagwala, District Etah pending in the Court of the Additional District and Sessions Judge, Court No. 2, Etah as well as non bailable warrant dated 08.12.2015.
When this application came up before the Court, learned counsel for the applicant, Mr. Umesh Kumar confined his prayer to questioning the non bailable warrant dated 08.12.2015 and the subsequent warrants issued against the applicant. In view of the fact that there is no substantive challenge to the proceedings or an order, the prayer to quash the mere process cannot be granted. The prayer to quash the non bailable warrant dated 08.12.2015 or the subsequent process is refused . However, in case the applicant surrenders within 15 days of date and applies for bail, the same shall be considered by the Court concerned, expeditiously.
This application is disposed of in terms of the aforesaid orders.
