Heard learned counsel for the petitioner and Shri Komal Mehrotra, learned counsel appearing for the plaintiff-respondent no. 1.

This petition has been filed seeking the following relief:

"i) Set aside the order, dated 31-03-2023, passed by District Judge, Sambhal sitting at Chandausi, in Civil Misc. Appeal No. 41 of 2017 (New No. 1/2018) (Sunil Kumar and Another vs. Vaijayanti Devi & another) and

ii) Set aside the Order dated 22.07.2017 passed by Civil Judge (Senior Division) Chandausi, in Misc. Case No. 39 of 2004 (Sunil Kumar and Another vs. Vaijayanti Devi & another)."

It appears that a suit filed for cancellation of a sale deed by the plaintiff-respondent was decreed ex-parte pursuant to the judgment and order dated 11.5.2004. Thereafter, an application was filed under Order 9 Rule 13 of the C.P.C. on 19.10.2004. It is contended that the application under Section 5 of the Limitation Act was allowed on 26.7.2008 but, thereafter, by the impugned order dated 22.7.2017, the application under Order 9 Rule 13 of the C.P.C. rejected. It is contended that thereafter the appeal filed by the petitioner being Misc. Civil Appeal No. 41 of 2017 (New No. 1 of 2018) was dismissed by the District Judge, Sambhal by means of the impugned order of 31.3.2023. The contention of the learned counsel for the petitioner is that the application ought to have been allowed in the facts and circumstances of the present case inasmuch as the litigation ought to be based on the adjudication on merits of the

contentions of the parties. It is, further, stated that the sufficient cause from appearing in Order 9 Rule 13 of the C.P.C. has to be liberally construed where defence is reasonable and defendant approaches the court for setting aside the ex-parte decree within statutory period and nonappearance is not mala fide or intentional. In support of his contention, learned counsel for the petitioner has relied upon a judgment of this Court in the matter of Deep Chandra and others Vs. VIIth Addl. District Judge, Agra and others¹ and the judgments of the Supreme Court in the case of G.P. Srivastava Vs. R.K. Raizada and others² and Robin Thapa Vs. Rohit Dora³ .

The operative part of the impugned order dated 22.7.2017 reflects as follows:

"्ቚाቕኍ�गण ्ቛारा ्ቚाቕኍ�नाप्ቔ 3 ग में कቕኍन किकया गया है किक उन्हें सम्यक रूप से नोकि�स तामील नहीं कराया गया। कि"प्ቌी संख्या-1 ने मूल "ाद में दुቝኋा�"ना पूण� तरीके से सम्मन " नोकि�स का तामीला कराकर "ाद की काय�"ाही अ्ቇसारिरत करायी है ्ቚाቕኍ�गण (जो किक मूल "ाद में ्ቚतित"ादी संख्या 2 " 3 ቕኍे) ्ቚाቕኍ�गण ने ्ቚाቕኍ�नाप्ቔ में यह कቕኍन किकया है किक किदनाँक 10.12.03 को जानकारी होने पर न्यायालय में उपቝኌ2ቕኍत आये और अकि्ቇम तितथिቕኍ किदनाँक 02.01.04 की किनयत की गयी। मुकदमे की पैर"ी ्ቚाቕኍ� सुनील कुमार ही करते रहे और दूसरे ्ቚाቕኍ� सुशील कुमार का 2"ा2थ्य ठीक नहीं रहता ቕኍा। ्ቚाቕኍ� सुनील कुमार किदनाँक 02.01.04 को बाहर चले गये और अपने अति;"्ሹा को ቝኋी सूचना नहीं दे पाये। 15-20 किदन बाद लौ�ने पर गम्ቝኋीर रूप से बीमार हो गये बाद में किदनाँक 24.09.04 को किकसी ्ቚकार जानकारी होने पर किक कोई मुकदमा न्यायालय सिसकि"ल जज "रिर्቗ खण्ड चन्दौसी में कि"चारा;ीन है तो न्यायालय आने पर मुआयना करने पर पता चला किक मूल "ाद एक प्ቌीय रूप से किदनाँक 11.05.04 को किनቓኌणत हो गया। जब किक कि"प्ቌी संख्या -1 "ादनी ने अपनी आपቈኌG में यह कቕኍन किकया है किक ्ቚाቕኍ�गण किदनाँक 20.10.03 को उपቝኌ2ቕኍत हुआ और ्ቚाቕኍ�नाप्ቔ 16 ग ्ቚ2तुत कर काय�"ाही को 2ቕኍकिगत कर"ाया। पुनः किदनाँक 05.11.03 को तितथिቕኍ किनयत होने और ्ቚाቕኍ�गण ्ቛारा मूल "ाद की काय�"ाही को 2ቕኍकिगत कराया गया। उसके प्ቐात् किदनाँक 19.11.03 को तितथिቕኍ किनयत हुई। उ्ሹ तितथिቕኍ पर ቝኋी ्ቚाቕኍ�गण ्ቛारा ्ቚतित"ादप्ቔ ना दाቈኌखल कर 2ቕኍगन ्ቚाቕኍ�नाप्ቔ ्ቚ2तुत किकया गया। पुनः किदनाँक 02.01.04 की तितथिቕኍ किनयत हुई और कि"प्ቌी संख्या -2

तित"ादी मु्ቐी दे"ी ्ቛारा 2ቕኍगन ्ቚाቕኍ�नाप्ቔ ्ቚ2तुत कर काय�"ाही 2ቕኍकिगत करायी गयी। कि"प्ቌी संख्या-1 ्ቛारा आपቈኌG में किकये गये उपरो्ሹ कቕኍनो की पुकिL मूल "ाद की प्ቔा"ली के अ"लोकन से हो रही है। सिजससे यह 2पL है किक ्ቚाቕኍ�गण ्ቛारा मूल "ाद में उपቝኌ2ቕኍत होने के प्ቐात् कई तितथिቕኍयों पर "ाद उGर दाቈኌखल किकये जाने हेतु मौका ቈኌलया गया। किकन्तु "ाद उGर दाቈኌखल नहीं किकया गया और अन्ततः उन्होंने मुकदमे की पैर"ी छोड़ दी।

जहाँ तक ्ቚाቕኍ�गण के इस कቕኍन का ्ቚ्቞ है किक सम्मन की तामील दुቝኋा�"ना पूण� तरीके से करायी गयी है यकिद उसे पूण�तः सही माना जाये तो ቝኋी ्ቚाቕኍ�गण ्ቛारा न्यायालय में उपቝኌ2ቕኍत आ जाने के प्ቐात् बार बार मौका लेने पर ቝኋी "ाद उGर्ቚ 2तुत नहीं किकया जाना , 2पL रूप से "ाद के ्ቚतित लापर"ाही " उपे्ቌा का परिरचायक है। किदनाँक 02.01.04 के बाद कቝኋी ቝኋी मूल "ाद की प्ቔा"ली में उपቝኌ2ቕኍत नहीं हुये और लगातार कई महीनो तक बीमार रहने के बाबत कोई ቝኋी अथिቝኋलेखीय साቌኚय ्ቚ2तुत नहीं किकया गया है। सिजससे ्ቚቕኍम दृLया यह 2पL हो सके, किक ्ቚाቕኍ�गण बीमार होने के कारण मूल "ाद की पैर"ी नहीं कर पाये।"

The trial court further observed as follows:

"्ቚाቕኍ�गण की ओर से ्ቚ2तुत उपरो्ሹ कि"ति; व्य"2ቕኍा ्ቚ2तुत मामले के तथ्यों ए"ं परिरቝኌ2ቕኍतितयों में पूण�तः लागू नहीं हो रही है। क्योंकिक ्ቚाቕኍ�गण मूल "ाद में उपቝኌ2ቕኍत आ चुके ቕኍे और उनके ्ቛारा "कालतनामा ቝኋी लगाया गया है लगातार कई तितथिቕኍयों पर 2ቕኍगन ्ቚाቕኍ�नाप्ቔ ्ቚ2तुत कर "ाद उGर दाቈኌखल किकये जाने हेतु मौका ቝኋी ቈኌलया जाता रहा।

उपरो्ሹ "ቓኌणत माननीय न्यायालय ्ቛारा किदये गये किदशा किनदWशों के आलोक में प्ቔा"ली के अ"लोकन से यह 2पL है किक ्ቚाቕኍ�गण ्ቛारा ्ቚाቕኍ�नाप्ቔ अन्त�गत आदेश 9 किनयम 13 सी०पी०सी० में किदनाँक 02.01.04 से किदनाँक 11.05.04 तक की अनुपቝኌ2ቕኍतित के संबं; में कोई 2पL ठोस " संतोषजनक कारण नहीं बताया गया है ऐसा ्ቚतीत होता है किक ्ቚाቕኍ�गण ने जानबूझकर और "ादनी / कि"प्ቌी संख्या-1 को हैरान " परेशान करने की गरज से लगातार अनुपቝኌ2ቕኍत रहें और मूल "ाद को एक प्ቌीय रूप से किनቓኌणत होने किदया। ्ቚाቕኍ�गण की मूल "ाद में अनुपቝኌ2ቕኍतित किकसी ቝኋी रूप में सद ् ़ቝኋाकि"क नहीं कही जा सकती है, बቝኌ]क दुቝኋा�"नापूण� आशय से ्ቚाቕኍ�गण ने मूल "ाद को एक प्ቌीय रूप से किनቓኌणत होने किदया है। कि"प्ቌी संख्या-1 की ओर से्ቚ 2तुत आपቈኌG के समቕኍ�न में य्ቕकिप कोई शपቕኍप्ቔ ्ቚ2तुत नहीं किकया गया है , किकन्तु इससे ्ቚाቕኍ�गण को कोई लाቝኋ किमलने की सम्ቝኋा"ना नहीं है , क्योंकिक ्ቚाቕኍ�गण्ቚ ाቕኍ�नाप्ቔ में किकये गये अपने कቕኍनों को सिस्ቍ कर पाने में पूण�त कि"फल रहा है।"

5. The appellate court in the impugned order dated 31.3.2023 has affirmed the order passed by the trial court and has held as follows:

"16. उቝኋय प्ቌों की ओर से किकए गए कቕኍनों ए"ं मूल अथिቝኋलेख के परिरशीलन से 2पL है किक ्ቚतित"ादी स०-2 " 3 के उपቝኌ2ቕኍत आने के उपरान्त किदनांक 16.01.2004 को ्ቚतित"ादीगण की ओर से न्यायालय में कोई उपቝኌ2ቕኍत न आने कारण न्यायालय ्ቛारा ्ቚतित"ादीगण के कि"रु्ቍ एकप्ቌीय काय�"ाही का आदेश पारिरत किकया गया और किदनांक 11.05.2004 को एकप्ቌीय किनण�य पारिरत किकया गया। एकप्ቌीय किनण�य में पारिरत तिड्ቅी के किनष्पादन के ቈኌलए "ाकिदनी मुकदमा ्ቛारा किनष्पादन "ाद योसिजत किकया गया। तदोपरान्त किदनांक- 19.10.2004 को ्ቚतित"ादी सं0-2 " 3 / अपीलाቕኍ�गण ्ቛारा अ"र न्यायालय में एकप्ቌीय किनण�य किदनांकिकत - 11.05.2004 को अपा2त किकए जाने बाबत् उपरो्ሹ ्ቚाቕኍ�ना-प्ቔ 3 ग दाቈኌखल किकया गया। उपरो्ሹ अ"ति; में ्ቚतित"ादीगण/ अपीलाቕኍ�गण की ओर से अपनी अनुपቝኌ2ቕኍतित का कारण ्ቚाቕኍ�ना-प्ቔ 3 ग में यह उ्ቤेቈኌखत किकया है किक किदनांक- 10.12.2003 को सुनील कुमार न्यायालय में उपቝኌ2ቕኍत हुआ, ्ቚतित"ादी स०-3 की ओर से ቝኋी्ቚ तित"ादी सं0-2 सुनील कुमार ही पैर"ी कर रहा ቕኍा, सुनील कुमार अ"श्यक कारोबारी काय� से किदनांक 02.01.2004 को बाहर चले गये, अति;"्ሹा को ቝኋी

सूचना न दे पाये, लगቝኋग 15-20 किदन बाद "ापस लौ�े तो गमቝኋीर रूप से बीमार हो गये घर पर ही रहकर अपना घरेलू इलाज कराया, शारीरिरक दृकिL से काफी कमजोर हो जाने और कारबोर न कर पाने के कारण अቓኌቕኍक ቝኌ2ቕኍतित कमजोर हो गयी और अति;"्ሹा की फीस "हन न कर पाने के कारण उनसे सम्पक� नहीं किकया, ्ቚाቕኍ� को 24.09.04 को जानकारी हुई किक उसके कि"रू्ቍ कोई "ाद न्यायालय में कि"चारा;ीन है, तब अति;"्ሹा के माध्यम से अ"लोकन कराने पर ्ሺ ात हुआ किक मूल "ाद एकप्ቌीय रूप से तिड्ቅी हो गया है।

अपनी अनुपቝኌ2ቕኍतित के संबं; में अपीलाቕኍ�गण/्ቚतित"ादी सं0-2 " 3 की ओर से जो उपरो्ሹ कारण दशा�ये गये है, "ह पूण�तया आ;ार हीन ्ቚक� हो रहे हैं। किकस कारोबार के काय� से ्ቚतित"ादी सुनील कुमार बाहर गये ቕኍे, कहाँ गये ቕኍे, लौ�ने पर किकस गम्ቝኋीर बीमारी से ्ቇ2त हो गये, गम्ቝኋीर बीमारी का तिचकिकत्सक के ्ቛारा उपचार क्यों नहीं कराया, इस संबं; में कोई तथ्य 2पL नहीं किकया गया है। यहाँ तक किक किदनांक 24.09.2004 को जानकारी होने के संबं; में जो कቕኍन ्ቚाቕኍ�ना-प्ቔ 3 ग में किकया गया है, उसका ቝኋी कोई ्ቨोत 2पL नहीं किकया गया है। प्ቔा"ली पर अपीलाቕኍ� के कि"्ቛान अति;"्ሹा का "कालतनामा ቕኍा, कि"्ቛान् अति;"्ሹा न्यायालय में क्यों अनुपቝኌ2ቕኍत रहे, यह ቝኋी 2पL नहीं है।

कि"्ቛान् अ"र न्यायालय ने ्ቚ्቞ गत आदेश में ्ቚाቕኍ�गण/अपीलाቕኍ�गण ्ቛारा्ቚ ाቕኍ�ना-प्ቔ अन्तग�त आदेश 9 किनयम 13 सी०पी०सी० में किदनांक 02.01.04 से किदनांक- 11.05.2004 तक की अनुपቝኌ2ቕኍतित के संबं; में दशा�ये गये कारणों 2पL, ठोस " संतोषजनक न होने का किनष्कष� किदया है और ्ቚाቕኍ�गण/अपीलाቕኍ�गण ्ቛारा जानबूझकर "ाकिदनी/कि"प्ቌी सं0-1 को हैरान " परेशान करने की गरज से लगातार अनुपቝኌ2ቕኍत रह कर मूल "ाद को एकप्ቌीय रूप से किनण�त कराना माना तቕኍा्ቚ ाቕኍ�ना-प्ቔ 3 ग को दुቝኋा�"ना पूण� आशय से ्ቚ2तुत किकए जाने के किनष्कष� के साቕኍ्ቚ ाቕኍ�ना-प्ቔ 3 ग अन्तग�त आदेश 9 किनयम 13 " 151 सी०पी०सी० किनर2त किकया गया है। मामले के सम2त तथ्यों, परिरቝኌ2ቕኍतितयों ए"ं उपरो्ሹ कि"्ቨे षण के आ;ार पर कि"्ቛान् अ"र न्यायालय ्ቛारा उपरो्ሹ किनष्कष� किनकालने और ्ቚाቕኍ�ना प्ቔ 3 ग किनर2त करने में कोई अकिनयकिमतता कारिरत किकया जाना ्ቚक� नहीं हो रहा है। अपीलाቕኍ�गण/्ቚ तित"ादी स०-2 " 3 की ओर से मूल "ाद में उपቝኌ2ቕኍत न हो पाने का दशा�या गया कारण पया�्቎ " उतिचत नहीं पाया जाता है।

जहाँ तक अपीलाቕኍ�गण की ओर से अपील में उन पर सम्मन की तामीला में अकिनयकिमतता के संबं; में ቈኌलये गये आ;ार का ्ቚ्቞ है, इस संबं; में उ्ቤेखनीय है किक आदेश 9 कनयम 13 सी०पी०सी० ि के परन्तुक में यह 2पL उ्ቤेቈኌखत है किक यकिद किकसी न्यायालय का यह समा;ान हो जाता है किक ्ቚतित"ादी को सुन"ाई की तारीख की सूचना ቕኍी और उपसंजात होने के ቈኌलए और "ादी के दा"े का उGर देने के ቈኌलए पया�्቎ समय ቕኍा तो "ह एकप्ቌीय पारिरत तिड्ቅी को के"ल इस आ;ार पर अपा2त नहीं करेगा किक सम्मन की तामील में अकिनयकिमतता हुई ቕኍी। चूँकिक ्ቚतित"ादीगण/ अपीलाቕኍ�गण संबंति;त मूल "ाद में उपቝኌ2ቕኍत आ चुके ቕኍे, अतः अपीलाቕኍ�गण की ओर से ቈኌलया गया उपरो्ሹ आ;ार बलहीन है।"

I do not find any material irregularity or illegality in the orders impugned that may merit interference in this petition under Article 227 of the Constitution of India. As is evident from the orders of the court, the defendant-petitioner were found to be deliberately not appearing in the

courts on repeated dates and therefore, the impugned orders were passed. The judgments relied upon by the learned counsel for the petitioner are based on different facts, which would not be applicable in the facts and circumstances of the present case.

This petition is, accordingly, dismissed .
