Heard Sri Harendra Yadav, learned counsel for the petitioner.
This petition has been filed seeking following relief:
"I. Issue, an order or direction to set aside the impugned order dated 13.12.2022, passed by the learned District Judge, Court No. 3rd, District Azamgarh in Civil Revision No. 468/2008 (Ramroop Vs. Sahabal )filed on 14.10.2008.
II. Issue, an order allow the application 138 Ka filed by the petitioner in Civil Revision No. 468/2008 (Ramroop Vs. Sahabal ) filed on 14.10.2008."
However, learned counsel for the petitioner prays that he may be permitted to withdraw this petition as order of the trial court dated 14.10.2008 that was affirmed by the revisional court in its order dated 13.12.2022 is also required to be challenged.
This petition is, accordingly, dismissed as withdrawn with liberty to file a fresh petition making appropriate prayer and filing requisite documents within a period of ten days from today.
The certified copy of the documents on record shall be returned to the petitioner as per the rules after retaining photo copies thereof.
