Shri Prashant Rai, learned counsel for the petitioner and learned A.G.A for the State are present.
The present petition has been filed under article 227 of the Constitution of India to set aside the summoning order dated 24.11.2020 passed by Additional Chief Judicial Magistrate Court No. 10, Azamgarh, in complaint case no. 6619 of 2019 and order dated 10.01.2023 passed by Additional District and Session Judge, Court no. 7, Azamgarh by which the revisionist was summoned under section 420.
After some arguments, learned counsel for the petitioner submits that he does not want to press the petition and the same may be disposed of as not pressed with liberty to file appropriate application/proceedings before the court of competent jurisdiction.
In view of the above, the present petition is disposed of as not pressed with the aforesaid liberty.
