Heard Mr. S.D. Gupta, the learned counsel for petitioner and the learned A.G.A. for State.
This petition under Article 227 of the Constitution of India has been filed for a direction to Chief Judicial Magistrate, Sonbhadra to decide Criminal Case No. 8899 of 2021 (State Vs. Vipin Srivastava and Others), under sections 419, 42, 467, 468, 471 IPC, Police Station- Chopan, District Sonbhadra, within a time bound period.
At the very outset, learned counsel for petitioner fairly submits that charges have not yet been framed.
In view of above, present petition is misconceived, at this stage.
It is accordingly dismissed with liberty to petitioner to file afresh at appropriate stage.
