Heard learned counsel for the petitioner and learned AGA for the State.

This writ petition has been filed by the petitioner with the following prayer:-

i) issue an order or direction to learned court below to decide the Criminal Case no. 14 of 2020 (Smt. Pragati Agrawal vs. Prakhar Agrawal) under Section 12 of Domestic Violence Act, P.S. Kila, District Bareilly pending in the court of Additional Chief Judicial Magistrate, Vth, Bareilly, District Bareilly.

ii) any other suitable order or direction, which this Court may deem fit and proper in the circumstances of the case.

iii) award the cost of petition in favour of the petitioner.

Learned counsel for the petitioner has filed order-sheet of the court below, which reveals that no effective proceedings have been carried out in the matter for more than two years of filing of the case and the same is still pending at the stage of service of notice on private respondents. However, from the perusal of records it appears that proceedings of the case are prolonged due to non filing of report of District Probation Officer as well as want of taking effective steps by the applicant.

The learned court below is directed to expedite the hearing of the case and decide the same without granting unnecessary adjournment to either of the parties, in accordance with law, within a period of six months from the date of receipt of a certified copy of this order.

The writ petition is disposed off, accordingly.
