Learned counsel for the applicant has submitted that the present applicant, who is mother-in-law of the victim (since deceased), has been falsely implicated in the case as she has not committed any offence as alleged. Attention has been drawn towards the impugned FIR wherein the allegations of demand of dowry and cruelty have been levelled against all the three accused persons including the present applicant. Despite the specific allegation has been levelled against the husband of the present applicant, he has not been implicated for the reason that the allegations of the FIR were false and misconceived. During investigation, name of accused-Shiva, who is the brother-in-law (Devar) of the victim (since deceased), has been deleted from the charge sheet as the charge sheet has been filed against the present applicant and her son Ramu. In the last five years of marriage of his son, she never demanded any dowry from her daughterin-law (since deceased) or her family members. There is no complaint of cruelty in any manner whatsoever in the last five years. No specific allegation has been levelled against the present applicant and general allegation has been levelled against all accused persons. As a matter of fact, relations of the present applicant with her daughter-in-law were cordial. She is absolutely unaware as to why she has been implicated in the case despite the fact that she along with her husband was living separately and she had nothing to do with the family affairs of her son or his wife (since deceased). Being lady, the applicant may be enlarged on bail granting her the benefit of Section 437 Cr.P.C. He further submits that charge sheet has been filed.
