Learned counsel for the applicant has submitted that the present applicant has been falsely implicated in the case as he has not committed any offence as alleged. Learned counsel for the applicant has drawn attention of this Court towards the short counter affidavit filed on behalf of opposite party no.2 wherein vide para-5, it has been indicated that due to wrong advice, the First Information Report was lodged against the present applicant. The complainant/ opposite party no.2 has further stated that her daughter has got married with the present applicant and from the said wedlock, a male child has born, recital to this effect has been given in para-6. The year of birth of the prosecutrix has been indicated as 2004 as per Pariwar Register, which has been enclosed as Annexure No.SCA-1 of the short counter affidavit. Learned counsel for the applicant as well as learned counsel for the complainant have stated that presently, the prosecutrix is living with the family members of the present applicant along with her infant male child. Therefore, learned counsel for the applicant has submitted that if the present applicant is released on bail, he would be able to look after his wife and his newly born child properly.
