Heard learned counsel for the petitioner. Notice on behalf of the respondents no.1 and 2 has been accepted by the office of the Chief Standing Counsel.

With the consent of the parties, the petition is being disposed of at the admission stage.

¶8

The petitioner has approached this Court with the limited prayer that he is entitled to the revised pay and allowances. However, the same has not been paid. Though the petitioner has escalated the matter before the department by his representation dated 28.09.2021, a copy of which has been brought on record as annexure no.14 yet not decision has been taken.

Considering the fact that the matter is engaging the attention of the department and it is the department at the first instance who is to take a decision, accordingly this Court is not inclined to keep the matter pending.

With the consent of the parties, disposes of the petition with the direction to the respondent no.2 to take a decision on the pending representation of the petitioner by a reasoned and speaking order and inform the same to the petitioner.

It is made clear that the Court has not examined the case of the petitioner on merits and the authority concerned shall take a decision strictly in accordance with law.

With the aforesaid, the petition is disposed of.
