Heard learned counsel for the applicants, learned counsel for the private respondent and learned A.G.A. for the State.

The present application under Section 482 Cr.P.C. is filed with the prayer to quash the proceeding of Case No.316/2022 under Sections 498-A, 323, 504, 506 I.P.C. and Section 3/4 D.P. Act, Police Station Tulsipur, District Balrampur.

In pursuance of earlier order, parties are present before this Court and they have been duly identified by their respective counsels.

Learned counsel for the parties jointly informed that due to some misunderstanding, complaint in question was lodged, and now the issue has already been resolved and they are enjoying their matrimonial life, therefore, impugned proceedign is a futile exercise.

Private respondent has no objection, in case, the impugned proceeding is quashed.

Learned A.G.A. opposed the prayer of the applicant but he does not dispute this fact that impugned proceeding is a result of some matrimonial dispute, therefore, he has no objection, in case impugned proceeding is quashed.

Considering the submissions of learned counsel for the parties, going through the record as well as statement of the private respondent that she does not pursue the case, as she is residing with her husband and enjoying her matrimonial life, therefore, impugned proceeding is liable to be set aside.

In view of the above, the present application under section 482 Cr.P.C. is allowed and the impugned proceeding is hereby quashed.
