Heard Shri Vivek Chandra, learned counsel for the petitioner, Shri Prashant Kumar Srivastava, learned counsel for the respondent No.2 and learned Standing Counsel.
Submission of learned counsel for the petitioner is that the petitioner has taken an agricultural loan of Rs.7,94,000/- under the KCC Scheme from respondent No.2-Bank on 13.06.2015 but she could not repay the same. Therefore recovery has been issued. The petitioner is not in a position to deposit the whole amount, however, the petitioner is ready to deposit the loan amount in easy installments as fixed by this Court.
Learned counsel for the respondent No.2, on the basis of instructions, submits that as on today, the total amount to be paid is Rs.8,97,677/- and in case the same is paid in installments fixed by this Court, he has no objection.
In view of above, the writ petition is disposed of providing herein that the petitioner shall deposit Rs.2,50,000/- within six weeks from today and the remaining amount in five equal quarterly installments along with interest till the date of payment. On deposit of Rs.2,50,000/- as provided by this Court, the respondent Bank shall provide a statement of account to the petitioner within 15 days.
It is made clear that in case there is any default by the petitioner, the bank shall be at liberty to recover the amount in accordance with law, however if the petitioner complies the aforesaid time schedule no coercive action shall be taken against the petitioner.
