It has been contended by the learned counsel for the applicant that the applicant is in jail since 259 of 2022 u/s 363, 366, 376 IPC & POCSO Act, P.S. Achalganj, District Unnao. It has been submitted that the applicant has been falsely implicated in this case as he has not committed any offence as alleged. At the very outset learned counsel for the applicant and learned counsel for the complainant / informant have submitted that the prosecutrix is residing with the family members of the applicant as she got married with the applicant. She is pregnant of more than eight months and the expected date of delivery is 25.1.2023. The complainant as well as the father of the accused-applicant are present in the Court and both have confirmed the aforesaid fact which has been informed by the learned counsel for the parties. Learned counsel for the applicant has fairly stated that when the applicant got married with the prosecutrix she was not of the marriageable age but after marriage she became pregnant and living with family members of the applicant, therefore, if the applicant is released on bail he may look after his wife and his child properly inasmuch as it is his responsibility to take care of both i.e. his wife and child. He has also submitted that the present applicant has no criminal history of any kind whatsoever and the offence in question i.e. to get married with a lady who is not of marriageable age and establishing physical relation
