Having heard learned counsel for the parties and having perused the material available on record, since after rejection of first bail application of the present applicant along with her husband on 9.9.2021 her husband has been granted bail on 4.11.2022 and one co-accused Anoop Singh has been granted bail on 13.9.2022 whereas the allegations against all the accused persons are same, so this ground may be considered as a fresh ground to consider the second bail application. Besides, after rejection of first bail application of the present applicant the sole independent eye witness Chandrika has been examined who has categorically deposed that the deceased was very much fed up with her husband as her husband was drunkard and even on the date of incident he was heavily drunk. On account of such reasons she earlier tried to commit suicide. The daughter of the deceased who is also an eye witness has categorically deposed that she has not seen as to who had committed the crime in question but she saw her mother burning with flames and she tried to put some water to douse the flames, so this subsequent event may be considered as a fresh ground to consider the second bail application. Even as per the statement of the Doctor (P.W.-4) before the Court on 22.10.2022 the case, prima-facie, appears a case of suicide. Besides, all the aforesaid fresh grounds this Court has also considered the fact that on similar allegations the husband of the present applicant, Ramesh Singh, has been granted bail by this Court and she being a lady is in jail for more than two and half year, therefore, she may be enlarged on bail.
