Heard Sri Vaibhav Srivastava, the learned counsel for the applicant as well as Sri Manoj Kumar Sahu, the learned A.G.A. for the State and perused the record.

The instant application has been filed seeking release of the applicant on bail in Case Crime No. 313 of 2022, under Sections 147, 148, 149, 302, 307, 323, 325, 427, 504 I.P.C, registered at Police Station Kotwali Bikapur, District Ayodhya/Faizabad.

The aforesaid case has been registered on the basis of F.I.R. lodged on 02.08.2022 against eight named accused persons, including the applicant and seven to eight unnamed women, stating that at about 2:30 pm on 02.08.2022, all the accused persons attacked the informant and his family members and subsequently the informant's brother died.

The learned counsel for the applicant has submitted that the co-accused persons Rita Verma, Geeta Verma and Myaram Verma, have already been granted bail by means of an order dated 13.01.2023, 14.02.2023 and 16.05.2023 passed by a coordinate bench of this Court in Criminal Misc. Bail Application Nos. 647 of 2023, 1174 of 2023 and 1426 of 2023,

respectively.

The learned A.G.A. has opposed the prayer of the bail, but he could not dispute the aforesaid aspects of the matter.

Having considered the aforesaid facts and circumstances of the case and keeping in view the fact that the F.I.R has been lodged against eight named accused persons and seven to eight women levelling similar allegations against all of them and three of the co-accused persons have already been granted bail and without making any observations which may affect the merits of the case, I am of the view that the applicant is also entitled to be released on bail on the ground of parity.

Accordingly, this bail application stands allowed.

Let the applicant- Ravi Shanker Verma be released on bail in Case Crime No. 313 of 2022, under Sections 147, 148, 149, 302, 307, 323, 325, 427, 504 I.P.C, registered at Police Station Kotwali Bikapur, District Ayodhya/Faizabad, on furnishing a personal bond and two sureties each in the like amount to the satisfaction of Magistrate/Court concerned, subject to the following conditions: -

(i) the applicant shall not tamper with the prosecution evidence;

¶18

(ii) the applicant shall not pressurize the prosecution witnesses;

¶19

(iii) the applicant shall appear on each and every date fixed by the trial court.

In case of breach of any of the above conditions, the prosecution shall be at liberty to move bail cancellation application before this Court.
