Heard Sri Vivek Pandey, learned counsel for the revisionist and Sri Rajeev Verma, learned Additional Government Advocate-I for the State.
The instant criminal revision under Section 397 Cr.P.C. has been filed by the present revisionist with the prayer to set aside the order dated 23.02.2023 passed by Principal Judge, Family Court, Sitapur in Criminal Case No.572 of 2019, Smt. Rashmi Singh and other vs. Ketan Singh, under Section 125 Cr.P.C. and further be allow the paternity test of the child/respondent no.2.
At the outset, the learned counsel for the revisionist has submitted that he want to withdraw this criminal revision since the main petition under Section 125 Cr.P.C. has already been decided. Therefore, he prays for liberty to raise this issue, along with other grounds, while filing a criminal revision.
Learned A.G.A. has no objection to the aforesaid prayer made by learned counsel for the revisionist.
Accordingly, the instant criminal revision is dismissed as withdrawn with the aforesaid liberty .
OfÏce is directed to return the certified copy of the documents annexed to the instant criminal revision, if any, to learned counsel for the revisionist after retaining a copy of the same.
