This Court after hearing the parties on 03.11.2023 found that it is a fit case for being referred to the arbitrator and had proposed the name of Hon'ble Mr. Justice Shailendra Saxena (Retd.) Judge of this Court to act as an Arbitrator and sought his consent.

As per the office report dated 22.11.2023, it indicates that the consent has been received.

Accordingly, the Court appoints Hon'ble Mr. Justice Shailendra Saxena (Retd.) Judge of this Court, Resident of MIG-A, Sector-C, Aliganj, Lucknow, Mobile No.9450131516 as a Arbitrator, who shall enter into the reference and decide the same.

The Registry of this Court is directed to communicate the order passed today to Hon'ble Mr. Justice Shailendra Saxena (Retd.) Judge of this Court, who shall enter into the reference and decide the dispute arising in between the parties.

In view of the aforesaid, the petition is allowed .
