Heard Sri Sunil Kumar Misra learned counsel for the petitioner.
Pursuant to the last order, Sri Sunil Kumar Misra learned counsel for the petitioner states that the defaulted amount of compensation money has been deposited through two separate Demand Drafts dated 20.5.2022 for Rs. 57,73,592/- and Rs. 53,92,037/- Both Demand Drafts are drawn on Central Bank of India, in favour of Nyayadhikaran Nagar Mahapalika Agra AV AM VP Agra.
Relying on the contends of the sanction order dated 19.5.2022, it has been further stated that by the aforesaid two Demand
Drafts, the entire amount claimed by Navneet Bansal and Tarun Bansal has been deposited.
Leaving the issue of reconciliation of the recoverable amount, it does appear, on prima facie basis, compliance has been made by the petitioner. No further direction is required to be issued at the instance of the petitioner.
In view of the above, cause of action does not survive in the present petitions.
Accordingly the writ petitions are dismissed as having rendered infructuous.
On the request of learned counsel for the petitioner, it is provided that the deposits made by the petitioner will not prejudice the right of the petitioner to file appeal against the award of the reference Court and also objection in the pending execution proceedings which proceedings may be dealt with on their own merits.
