Shiv Vishal Vs State of U.P. and 3 Others

While challenging the order dated September 29, 2021, the grievance raised by the petitioner is that before carrying out the demarcation of the land, to ascertain as to which portion of the land mentioned by the petitioner is being utilised for the construction of the road, he was not informed, and in absence thereof, the report cannot be relied upon. The grievance of the petitioner, which was raised by the petitioner in the earlier writ petition filed by him, has not been redressed as the claim had to be decided after hearing the petitioner and carrying out the demarcation in his presence.

Learned counsel for the respondents did not dispute the fact that at the time of demarcation, the petitioner was not informed.

After hearing learned counsel for the parties and considering the aforesaid facts, in our opinion, fresh demarcation is required to be carried out at the spot, after intimating the petitioner the date and time

thereof, so that the issue raised by the petitioner regarding his land being utilised for construction of road, can be resolved. Let the aforesaid exercise be carried out within a period of two months.

The petition is, accordingly, disposed of.
