Learned counsel for the petitioner is permitted to implead concerned gram sabha as party respondent in the array of the respondents during the course of the day.
Heard learned counsel for the petitioner. Learned Standing Counsel accepted notice on behalf of respondent No.1 and learned counsel for respondent No.8/Gram Sabha.
In view of the order proposed to be passed, notices need not go to the respondent Nos.2 to 7.
The petitioner has preferred the present writ petition with the prayer to issue a mandamus directing the respondent No.1/Commissioner Basti Division, Basti to decide Appeal No.C201917000000526 (Suresh Kumar Vs. Ram Krishna and others) expeditiously.
It is contended by learned counsel for the petitioner that the matter is pending since long, till date no decision has been final taken and prays for expeditious disposal.
Learned Standing Counsel has no objection to the prayer made by petitioner.
Heard learned counsel for the parties present. With the consent of learned counsel for the parties present, the present writ petition is disposed of at the admission stage itself.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the respondent No.1/Commissioner Basti Division, Basti to consider and decide the aforesaid appeal in accordance with law expeditiously and preferably within a period of four months from the date of production of certified copy of this order but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
