The petitioners have preferred the present petition inter-alia with the following prayer:-

"(a) Issue a writ, order or direction in the nature of mandamus directing the respondents to declare the petitioners as Sankramaniya Bhumidhars with transferable rights from Asankramaniya Bhumidharss over Khasara Nos. 781M and 786M situated at Village Kanhepur, Pargana Shamsabad Purva, Tehsil Sadar, District Farrukhabad at an early date, in accordance with law."

It is argued that in this regard a representation has been made by the petitioners before the District Magistrate, Farrukhabad/respondent no. 2 on 21.08.2021, copy of which is appended as annexure-3 to the present petition.

It is argued by the learned Standing Counsel that the competent authority in the matter is Tahsildar, as such petitioners are permitted to move an application before the respondent no. 4 namely Tehsildar, Tehsil Sadar, District Farrukhabad.

Heard counsel for the parties.

With the consent of counsel for the parties and without expressing any opinion on the merits of the case, the present petition is disposed of finally permitting the petitioners to move a fresh representation ventilating all his grievances before the concerned competent authority. If such application is filed within a period of three weeks from today, the concerned competent authority will decide the same in accordance with law expeditiously and preferably within a period of three months from the date of production of certified copy of this order after providing an opportunity of hearing to all the parties, there is no legal impediment.
