Heard learned counsel for the petitioner. Learned Standing Counsel accepted notice on behalf of respondent No.1.
In view of the order proposed to be passed, notices need not go to the respondent Nos.2 & 3.
The petitioner has preferred the present writ petition with the prayer to issue a mandamus directing the respondent No.1/Tehsildar Tehsil Kasia District Kushinagar to decide the mutation case No.02263 of 2021 (Computer Case No.T202105440402263 (Mala Devi Vs. Rajendra).
It is contended by learned counsel for the petitioner that the matter is pending since long, till date no decision has been final taken and prays for expeditious disposal
Learned Standing Counsel has no objection to the prayer made by petitioner.
Heard learned counsel for the parties present. With the consent of learned counsel for the parties present, the present writ petition is disposed of at the admission stage itself.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the respondent No.1/Tehsildar Tehsil Kasia District Kushinagar to consider and decide the aforesaid case in accordance with law
expeditiously and preferably within a period of three months from the date of production of certified copy of this order but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
