The petitioner claimed that the extension of existing Mahila Hospital, Delhi Garh Road, Hapur is being made by including his property. It is pointed out that the District Magistrate has called for a report from Lekhpal which was duly submitted by him on 04.01.2022. However, without taking any decision in the matter, the respondents are threatening to dispossess the petitioner from his House No. 162 situated at Mahila Hospital, Delhi Garh Road, Hapur.
Learned Standing Counsel and learned counsel for respondent no. 3 fairly state that second respondent to whom the report has been submitted by the Lekhpal may be directed to decide the claim of the petitioner.
Accordingly, without entering into merits, we direct respondent no. 2 to decide the claim of the petitioner after taking into consideration the evidence as may be filed by him along with true attested copy of the instant order and a fresh representation within two weeks from today.
As soon as the representation is filed respondent no. 2 will fix a date for hearing the petitioner as well as the respondent no. 3 and then pass a speaking order within next four weeks.
