On oral mention made by learned counsel for the petitioner that the matter is extremely urgent as there is threat of demolition of constructions of the petitioner, we sent for the record of the case and it is heard in presence of learned counsel for the parties.

The petitioner has filed an appeal before the Chief Executive Officer, Yamuna Expressway Industrial Development Authority, Noida against the demolition order passed under Section 10 of the U.P. Industrial Area Development Act, 1976 read with the demolition Rules.

The case of the petitioner is that the Appellate Authority has not considered the stay application filed by the petitioner along with memo of appeal and there is threat of the demolition order being implemented.

Learned counsel for the respondent-Authority states that the appeal will be decided expeditiously.

¶9

Having regard to the submissions made, we dispose of the instant petition by providing that the stay application filed by the petitioner be decided on the next date as far as possible and also decide the appeal in three months.

Until the stay application is decided, the order under challenge in appeal will not be given effect to. The stay application will

be decided without being influenced by the protection granted to the petitioner by the instant order.
