Sri Aditya Bhushan Singhal, learned counsel for the respondent Authority, submits that the petitioner has alternative remedy of approaching the State Government under Section 41(3) of the U.P. Urban Planning and Development Act, 1973.
After making brief submissions, learned counsel for the petitioners, prays for withdrawal of the instant petition with liberty to the petitioners to file revision before the State Government under Section 41(3) of the U.P. Urban Planning and Development Act, 1973, read with Section 12 of the U.P. Industrial Area Development Act, 1976.
The prayer made is allowed.
The petition is disposed of as withdrawn, with liberty in terms of the prayer made.
For a period of two weeks from today, the impugned order will remain in abeyance and no demolition will take place in pursuance thereof to facilitate the petitioner in approaching the State Government.
