Heard Sri Krishna Kumar Chaurasia, learned counsel for the petitioner, learned Standing Counsel for the respondent Nos.1, 2 and 3 and perused the record.

The instant writ petition has been filed for a writ of mandamus directing the respondent No. 2 i.e. Commissioner, Varanasi, Division-Varanasi to decide the stay application dated 06.08.2021 filed by the petitioner in Appeal No. C20211400001166 (Alok Kumar Singh Vs. Kailashpati Singh and others) under Section 207 of U.P. Revenue Code, 2006 pending before him within stipulated period.

The petitioner filed an appeal before the respondent No.2 under Section 207 of U.P. Revenue Code, 2006 on 06.08.2020 in which stay application filed by petitioner is pending. Parties have put in appearance.

A copy of order sheet has also been filed by the petitioner as Annexure No.7 to the writ petition in order to demonstrate that the aforementioned case is not proceeding expeditiously.

In view of the facts and circumstances of the case, without expressing any opinion on the merits of the case, the present writ petition is finally disposed of directing the respondent No. i.e. Commissioner, Varanasi, Division-Varanasi to decide the stay application pending in aforementioned case in accordance with law, expeditiously, preferably within a period of two months from the date of production of a certified copy of this order before him, without granting unnecessary adjournments to either of the parties.
