The instant writ petition has been filed for a writ of mandamus directing the respondent No.2 i.e. Sub Divisional Magistrate Tehsil Machhalishahar to decide the computerized Case No. T201914360307281 of 2019 (Amrit Lal Vs.Gram Sabha and others) under Section 24 of U.P. Revenue Code, 2006 pending before Sub divisional Magistrate, Jaunpur within stipulated period.
Petitioner has applied for demarcation under section 24 of U.P. Revenue Code 2006 in the year 2019. The opposite parties have put in appearance, but the aforementioned case has not yet been decided by respondent No. 2
The petitioner has also annexed copy of the order sheet of the aforementioned case as annexure No.5 to the writ petition to demonstrate that the aforesaid case is not proceeding expeditiously.
I have perused the record.
In view of the facts and circumstances of the case, without expressing any opinion on the merits of the case, the present writ petition is finally disposed of directing the respondent No. 2 i.e. Sub Divisional Magistrate, Tehsil Machhalishahar to decide the aforementioned case in accordance with law, expeditiously, preferably within a period of four months from the date of production of a certified copy of this order before him, without granting unnecessary adjournments to either of the parties.
