Heard Sri Ambuj Srivastava, learned counsel for the petitioner and learned Standing Counsel for the respondent Nos.1 and 2 and Sri Rameshwar Prasad Shukla, learned counsel for the Gram Sabha-respondent No.3.

The instant writ petition has been filed for a writ of mandamus directing the respondent No.2 i.e. Upzila Adhikari, Sikandarpur, District-Ballia to decide the Suit No.0527 of 2018 computerized Suit No. T-201815090200527 (Sachidanand and others vs. Gopal and others) under Section 144 of the U.P. Land Revenue Code pending before him within stipulated period.

The suit under Section 144 of the U.P. Land Revenue code, 2006 has been filed in the year 2013. Parties have been served in the suit but the aforementioned case has not yet been decided.

A copy of order sheet has also been filed by the petitioner as Annexure No.3 to the writ petition in order to demonstrate that the aforementioned case is not proceeding expeditiously.

I have perused the record.

In view of the facts and circumstances of the case, without expressing any opinion on the merits of the case, the present writ petition is finally disposed of directing the respondent No.2 i.e. Upzila Adhikari, Sikandarpur, District-Ballia to decide the aforementioned case in accordance with law, expeditiously, preferably within a period of one year from the date of production of a certified copy of this order before him, without granting unnecessary adjournments to either of the parties.
