The instant writ petition has been filed praying for a mandamus commanding the respondents to decide upon the right being claimed by the petitioner under the provisions of the Scheduled Tribes & Other Traditional Forest Dwellers (Recognition of Forest Rights), Act 2006 and the Rules framed thereunder. According to the petitioner he is traditional forest dweller belonging to scheduled tribe. He has filed an application before the Gaon Sabha for setting in motion the process for determination of forest right as contemplated under Chapter-IV of the Act. It is stated that the application filed by the petitioner is not being processed.
Learned Standing Counsel appearing for the State-respondents and Sri Pradeep Singh, counsel for the respondent no.4 state that the application filed by the petitioner shall be processed in accordance with law.
Accordingly, the petition is disposed of with direction to the respondents to process the application as per the procedure prescribed under Section 6 of the Act and the relevant Rules framed thereunder expeditiously.
The petition stands disposed of.
