This petition was filed by alleging that brick kiln owners without clearance/no objection certificate from the Pollution Control Board were running the brick kilns illegally therefore an order was issued on 15.07.2021 for closure of as many as 272 brick kilns in district Ballia which was communicated to the District Magistrate, Ballia (third respondent).
In the petition it is alleged that the above order has not been fully complied and therefore a direction be issued upon the District Magistrate to ensure its compliance.
Learned Standing Counsel has obtained written instructions from the District Magistrate, Ballia. On instructions, learned Standing Counsel submits that all the unauthorized brick kilns have now been shut.
The written instructions obtained by the learned Standing Counsel have been provided to the Court.
In view of the above, the cause of action does not survive. The petition is disposed off .
The written instructions provided by the learned Standing Counsel shall be retained on record.
It is made clear that if unauthorized brick kilns crop up again, the petitioner would be at liberty to file a fresh petition.
