A supplementary afÏdavit has been filed today annexing therewith an order dated 30.09.2022 passed in Writ C No.29319 of 2022 which was filed by respondents 5 to 8. A perusal of the said order would reflect that the demolition order dated 30.08.2022, of which execution is sought by the petitioners through this writ petition, has been subjected to an appeal under Section 18 of the 1958 Act. The said appeal has been filed by private respondents 5 to 8. It also appears from the order dated 30.09.2022 that the respondents 5 to 8 had filed a stay application and as the controlling authority was not considering the stay application, the private respondents 5 to 8 had filed Writ C No.29319 of 2022. The said writ petition was therefore disposed off vide order dated 30.09.2022, directing the controlling authority to decide the stay application within two weeks from the date of the writ court's order and if possible to decide the appeal itself within the said time frame. It was also provided that in case hearing of the appeal is not possible, it would be desirable that the stay application is disposed off. After directing as above, the writ court directed that for a period of three weeks from that day, the demolition order dated 31.08.2022 will remain in abeyance.
