It is argued by the counsel for the petitioner that in the appeal, a stay application dated 30.06.2022 was also filed by the petitioner against the order dated 22.06.2022 under Section 13(1) of the Uttar Pradesh Essential Commodities Distribution and Control Order, 2016, though the said appeal was duly entertained by the Joint Commissioner (Food), Saharanpur Division Saharanpur/respondent no.2 and records were called for fixing 23.08.2022 but no interim protection was granted.
It is further argued that even on 23.08.2022 no orders were passed on the application filed by the petitioner for the grant of interim protection.
On the other hand, it is argued by the counsel for the respondents that respondent no. 2 will pass order on the application for the grant of interim protection, expeditiously.
Heard counsel for the parties and perused the record.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the respondent no. 2 namely Joint Commissioner (Food), Saharanpur Division Saharanpur to consider and decide the aforesaid application strictly in accordance with law on the next date fixed in the matter after hearing all the parties concerned. If on account of any reason no orders were passed on the aforesaid date, the decision will be taken on the aforesaid application preferably within a period of three weeks , thereafter.
