Heard learned counsel for the petitioners and learned Standing Counsel for the State-respondents.

The petitioners have preferred the present petition inter alia for the following prayer:-

"(I) Issue a writ, order or direction in the nature of writ of Mandamus direct the respondent no. 2 to decide the application of the petitioners dated 28.08.2020 within stipulated time within time bound period as fixed by this Hon'ble Court."

It is argued by learned counsel for the petitioners that the petitioners are landless poor persons of gram Babina. After a resolution dated 9.7.2020, on 16.7.2020 gram pradhan and other officials organized a meeting for the purpose to mark the names of poor and landless persons of the village and thereafter allot them land for residential purposes. However, the demarcation of the land has yet not been done by the authorities concerned. In this regard a representation has been filed before respondent no. 2 (District Magistrate, Jhansi) on 28.08.2020 but till date actual possession has not been handed over to the petitioners.

In view of the submission advanced by the learned counsel for the petitioners and considering the facts of the case, this Court is of the opinion that the petitioners may be permitted to file a fresh representation raising all their grievances before respondent no.3-Sub-Divisional Magistrate, Jhansi, within a period of three weeks from today.

In case any such representation is filed by the petitioners, the respondent no.3 shall decide the same by a reasoned and speaking order within a period of two months thereafter after giving opportunity of hearing to all the concerned parties in accordance with law.

With the aforesaid observations, the writ petition is disposed of.
