The instant petition has been filed praying for a mandamus directing the respondent Development Authority to forthwith remove the encroachments over Plot No.A3, Sector 87, District Gautam Budh Nagar, admeasuring 6615.70 sq. meter and hand over physical possession of the same to the petitioner.
Indisputably, the said plot was allotted to the petitioner for industrial purposes. However, its possession could not be delivered to the petitioner, as it was in illegal possession.
Sri Kaushalendra Nath Singh, learned counsel appearing on behalf of respondent Development Authority has placed on record a letter dated 16.09.2022 issued by the Authority in the name of the petitioner informing him that the plot has now been made rid of encroachments and it is free to take its physical possession within three days. A copy of the said letter has also been provided to learned counsel for the petitioner, who very fairly states that in view of the above development, nothing further survives in the instant matter at this stage.
Having regard to the above, the instant petition stands disposed of with no further direction but with liberty reserved in favour of the petitioner to avail appropriate remedy in future if the grievance is not redressed satisfactorily.
