Heard learned counsel for the petitioners and Shri Yash Singhal, Advocate, holding brief of Shri Kartikeya Saran, learned counsel for the respondents.

The petitioners by instant writ petition seeking following reliefs:

i. Issue a writ of mandamus directing the respondent no. 4 to change the name of Mahant of Maharishi Balmiki Khalsa, Maghmela Prayagraj, DistrictPrayagraj on his record as petitioner no. 2 (Mahant Ram Gopal Das S/o Mahant Nritya Gopal Das Ji Maharaj) in place of Late Vijay Ram Das Ji S/o Mahant Nritya Gopal Das Ji Mahraj.

ii. Issue a writ of mandamus directing the respondent no. 4 to release the land and all facilities (Suvidha Parchi) which is provided by respondent no. 4, in favour of petitioner no. 2.

It is submitted by the learned Senior Counsel, that the allotment of plot/ land at the Magh Mela, Prayagraj, is being allotted against a dead person, who was earlier authorized by the petitioners. In the meantime, the first petitioner has nominated Mahant Ram Gopal Das, for the said purpose. Pursuant thereof, the second petitioner-Mahant Ram Gopal Das, has already made an application to the fourth respondent- Prayagraj Mela Pradhikaran, Prayagraj, for correction of their record, so that in future the plot/site may be allotted to the Trust through second petitioner. In this regard the petitioners have moved a representation, before the fourth respondent, dated 06.02.2022, which is pending consideration.

The learned counsel for the respondents submits that the grievance of the petitioners shall be redressed by the forth respondent.

In view thereof, on the consent of the parties, petition is disposed off, directing the fourth respondent to consider and decide the representation of the petitioners, by a reasoned and speaking order, within a period of four weeks, from the date of filing certified copy of the order along with copy of representation as well as writ petition.

It is clarified that the Court has not considered the rival contentions on merit.
