Heard learned counsel for the petitioner and Sri Ram Kinkar Shukla, learned counsel for the Union of India.

From the record it appears that the property in question, that is the Plot Nos. 99, 100 and 103, Khewat Nos. 43 and 67 and Plot No. 832/5-9 of Village Nakur, Pargana and Tehsil- Nakur, District- Saharanpur were declared enemy property by an order dated 03.5.2010 of the relevant authority. Further, from the record, it is clear that the petitioner under Section 18 of The Enemy Property Act, 1968 (herein after referred to as 'the Act') had represented for the exclusion of the property in question from the list of Enemy properties on 3.11.2019. When the matter was being decided a certain query was raised by authorities on 22.05.2022. Thereafter, it is the case of the petitioner that the reply to the query was given and when the matter was not still being decided, a representation / reminder was sent by the petitioner on 22.03.2022. Thus the crux of the matter is that the petitioner's representation which was filed on 03.11.2019 had not been decided till date.

Without going into the merits of the case and without expressing any opinion on the merits of the case, a direction is being issued that the petitioner's representation under Section 18 of the Act, 1968 be decided in accordance with law. It may be noted that the Court has also not given any decision with

regard to the delay etc. which was there is the filing of the representation of the petitioner under Section 18 of the Act filed on 03.11.2019. The representation, therefore, be decided in accordance with law within a period of two months from the presentation of a certified copy of this order.

Accordingly, the writ petition is disposed of.
