The instant petition has been filed praying for a mandamus directing the Chairman, U.P. Sunni Central Waqf Board, Lucknow to decide application of the petitioner dated 30.12.2015 for appointment of Mutwalli and Naib Mutwalli of Waqf No.36.

According to the application, the Waqif has not left any heir and, therefore, the petitioner has prayed for his appointment as Naib Mutwalli.

On query made by the Court as to under which provision, he is seeking his appointment as Naib Mutwalli, counsel for the petitioner submitted that the application has been filed in terms of Waqf deed. However, copy of the Waqf deed has not been brought on record.

Since counsel for the petitioner could not satisfy us even prima facie that the petitioner is entitled to be appointed as Naib Mutwalli, wherefore, we decline to issue any direction. However, we leave it open to the petitioner to press the application which is stated to be pending or avail such other remedy as may be advised.

The petition stands disposed of accordingly.
