The preliminary objection was raised by contesting respondent that this writ petition was filed on behalf of the dead petitioner, accordingly, on the last occasion, by the order of this Cort dated 28.07.2022, the case was adjourned for verifying the fact regarding the death of the sole petitioner.
Today, when the case is taken up, learned counsel for the petitioner submitted that by mistake petition was filed on behalf of dead petitioner, therefore he may be permitted to withdraw this writ petition and the writ petition may be dismissed as withdrawn with liberty to file a fresh petition.
In view of the statement of the learned counsel for petitioner, the writ petition is dismissed with liberty to file a fresh writ petition.
When the fresh petition will be filed, copy of the same will be served upon Mr. Naresh Chandra Tripathi, learned counsel for the respondents.
