Heard Mr.Yogesh Kumar Pandey, learned counsel for the petitioner and learned Standing Counsel for respondent Nos. 1 and 2.

The instant writ petition has been filed praying for a mandamus directing respondent No.2 i.e. Tehsildar, Tehsil-Sagari, DistrictAzamgarh to decide the Case No.2071 (Computerized Case No. T201315671372 (Ganika vs. Indrasani) under Section 34/35 of U.P. Land Revenue Act, 1901 within stipulated period. This Court vide order dated 06.09.2022 passed the following orders:

"The Tehsildar, Tehsil Sagari, District Azamgarh shall submit a report within a week explaining why the proceedings of Case No. 2071, Computer Case No. T201315671372, (Ganika Vs. Indrasani) under Section 34/35 of U.P. Revenue Code, 2006 are lingering on. Lay this matter as fresh on 14.9.2022.

Let this order be communicated to Tehsildar, Tehsil Sagri, District Azamgarh through the Collector, Azamgarh, by the Registrar (Compliance) within 48 hours "

In pursuance of the order of this Court instruction has been placed before this Court, in which it is specifically stated that mutation case has not been decided till date. It is also mentioned in the instructions that next date fixed in the case is 30th September, 2022.

Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to

respondent No..2 Tehsildar, Tehsil-Sagari, District-Azamgarh to consider and decide the aforementioned case in accordance with law expeditiously and preferably within a period of two months from the date of production of certified copy of this order after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties.
