Heard Shri Gautam, learned Counsel for the petitioner, learned Standing Counsel for respondent nos.1 to 4 and Shri Ajit Kumar Baranwal, learned Counsel for the respondent no.5.
The instant writ petition under Article 226 of the Constitution of India has been filed for challenging the impugned order dated 28.10.2017 passed by the respondent no.2, Assistant Director of Education Basic, Region, Gorakhpur-Basti whereby the payment of salary to the petitioner from July, 2011 to April 2017 has been denied.
Learned Counsel for the petitioner submits that the petitioner died during pendency of present writ petition on 09.05.2021 due to Covid-19 and as such no cause of action is surviving at present and same may be dismissed.
The Writ Petition is, accordingly, dismissed.
