Heard Sri Pushkar Kushwaha, learned counsel for the petitioner, learned Standing counsel for respondent no.1 and Sri Jai Ram Pandey, learned counsel for respondent nos. 2 to 4.
The present writ petition has been filed challenging the suspension order dated 7.1.2022 whereby the service of the petitioner working as Assistant Teacher in the Institution run and managed by the Basic Siksha Parishad has been suspended.
Learned counsel for the respondent nos. 2 to 4 on the basis of instruction received from the District Basic Education Officer, Mirzapur submits that on the basis of inquiry report dated 23.4.2022, the services of the petitioner was restored and she was reinstated on the post of Assistant Teacher.
Learned counsel for the petitioner admitted the said position and submits that in these circumstances, no cause of action survives and as such the writ petition has become infructuous and the same may be dismissed as such.
Accordingly, the writ petition is dismissed as having become infructuous.
