Heard Mr. Awadhesh Kumar Yadav, the learned counsel for petitioner and Mr. Pankaj Srivastava, learned counsel representing respondents- 1 and 2.

Petitioner has approached this Court for a writ of mandamus commanding respondents to declare the result of petitioner for the post of Soldier Tradesman (All Arms) 8th Pass bearing Roll NO. LUC/AM/TW/190120/53052 having NCC Certificate 'C' in the vacancy advertised on 8.9.2019.

Present writ petition came up for admission on 22.4.2022, and this Court passed the following order :

"Shri Awadhesh Kumar Yadav, learned counsel for petitioner seek and is granted time to take instructions as it is informed by Shri Pankaj Srivastava, learned counsel for respondents that petitioner has got less marks than cut off marks.

Put up this petition after two weeks, as fresh. "

Pursuant to above order Mr. Pankaj Srivastava, learned counsel representing respondents-1 and 2 submits that he has received instructions. Same have been placed before Court and are taken on record.

Perusal of paragraph 12 of the instructions so received, clearly goes to show that NCC 'C' certificate holders cleared physical, documentation and medical screening and were given admit cards for CEE under Soldier Tradesman 8th pass (house keeper) category. Out of these only 12 NCC "C" certificate holders have figured in the merit list. 13 have not. Petitioner Vijay Pal Yadav ranked 23 in cut-off merit list. Therefore, petitioner could not be appointed.

In view of above, the prayer made by petitioner is wholly misconceived.

The writ petition fails and is liable to be dismissed.

It is accordingly dismissed.
