The petitioner in pursuance of the Seniority List dated 24.7.2019 claims promotion from the post of Constable to Head Constable. Learned counsel for the petitioner states that the criminal case in which he was involved was of no consequence as he had been acquitted even before the Departmental Promotion Committee had taken the decision on the promotions.
Learned Standing Counsel produced instructions and stated that there was a departmental proceeding which was undergone against the petitioner and, therefore, the petitioner's case could not be considered for the period of five years commencing 1.7.2012 and ending 30.6.2017.
Be that as it may, ends of justice would be served if the petitioner's representation which had been filed on 13.12.2021 is decided in accordance with law by the respondent no. 3, the Chairman / Secretary, Uttar Pradesh Police Recruitment & Promotion Board, Lucknow, within a period of two months from the date of presentation of a certified copy of this order.
With these observations, the writ petition is disposed of.
