"1. Despite selection made and despite letter dated 06.10.2021 issued by the DIOS, Siddharth Nagar providing for appointment of the petitioner as Assistant Teacher TGT (Social Science) at Deen Bandhu Inter College Nadau, Siddharth Nagar, the petitioner has not been issued appointment letter by that institution. Consequently, he has not been able to join.
2. At present, the reason offered as to post non-existing, does not inspire confidence with the Court. Not only requisition made and selection carried out and select list declared by the Board but upon receipt of the same, the DIOS, Siddharth Nagar reconfirmed the existence of vacancy by issuing letter dated 06.10.2021, directing the institution to issue appointment letter to the petitioner. It is then difficult to assume how the vacancy ceased to exist in October 2021.
3. Put up as fresh on 16.12.2022.

In the meanwhile, the DIOS, Siddharth Nagar may ensure, the petitioner is allowed to join at the above named institution, if post exists, failing that, the said DIOS may file his personal affidavit to explain how recruitment came to be made on the post of Assistant Teacher (Social Science) when that post was not existing. Also, the affidavit would explain the exact number of sanctioned posts at the above named institution specifying details of Assistant Teacher TGT Grade posted at that institution as also names and full description of the persons regularly selected together with copies of their appointment letters. The affidavit will also specify the sanctioned strength at the institution at the time of requisition made together with the details of existing posts, today."
last order, the DIOS has enforced upon the respondent - Deen Bandhu Inter College, Nadau, Siddharth Nagar to allow the petitioner to join at that institution on the post of Assistant Teacher TGT (Social Science). That compliance has been made on 13.12.2022.
