Petitioner claims a right to compassionate appointment arising from the death of his father Ram Prakash, who died in harness on 23.12.2021 while working on Class IV post at Government Inter College Kant, Shahjahanpur. Arising from that unfortunate occurrence, the petitioner further claims to have filed an application seeking compassionate appointment on 23.05.2022.

At present, the petitioner seeks direction upon respondent no.2 to decide that application. Further, it has been stated, the petitioner is born to the first wife of the deceased. Earlier, the second wife of the deceased namely Smt. Annu had also raised claim for compassionate appointment. However, later, she has filed a joint affidavit with the petitioner and his mother withdrawing her claim and offering her no objection to the claim set up by the petitioner.

In view of such fact, no useful purpose may be served in keeping the present petition pending or calling for a counter affidavit, at this stage the claim raised by the petitioner deserves to be considered by respondent no.2 alongwith any competing claim that may have been filed by any other person.

Accordingly, the present writ petition is disposed of with a direction, in case the petitioner files a copy of this order before respondent no.2 within a period of two weeks from today, the said respondent shall proceed to hear and

decide the petitioner's claim for compassionate appointment alongwith any other similar claim that may have been made arising from the death of Ram Prakash (father of the present petitioner). Such order may be passed as expeditiously as possible, preferably within a period of three months from the date of compliance shown by the petitioner.
