- While other retiral dues have been paid out to the petitioner, gratuity has been withheld awaiting verification of documents. In the regard, the petitioner's representation dated 11.01.2022 is stated to be pending before the DIOS, Siddharth Nagar. Further, the DIOS, Siddharth Nagar has asked the Committee of Management to supply the necessary documents. That compliance has yet not been made by the Committee of Management.
- In view of such facts, no useful purpose would be served in keeping the present pending or calling for a counter affidavit at this stage.
- Accordingly, the present writ petition is disposed of with a direction, in case the petitioner files a copy of this order before respondent no. 2 within a period of two weeks from today, the said respondent shall cause for necessary enquiry to be made to ascertain the correct facts and pass a reasoned and speaking order with respect to the claim made by the petitioner as expeditiously as possible, preferably within a period of three months from the date of compliance shown by the petitioner.
- Any amount found payable, be paid out to the petitioner within a further period of one month therefrom.
