Heard Sri Rizwan Ahmad (Qureshi) learned counsel for the petitioner, Sri Avneesh Tripathi learned counsel for the University and the learned Standing Counsel for the State respondents.

Having heard learned counsel for parties and having perused the record, it transpires, at present petitioner is seeking a direction upon respondent No. 2 to permit him to resume his duty at MMH (PG) College, Ghaziabad. In that regard, petitioner further appears to have made a representation to respondent No. 3 on 03.8.2022.

Primarily, the said respondent has yet not considered the claim being made by the petitioner. The rights of the petitioner are thus unascertained.

In view of the above, no useful purpose may be served in keeping the petition pending or calling for a counter affidavit at this stage. Writ petition is disposed of with a direction, in case petitioner files a fresh representation before respondent No. 3 supported by his personal affidavit annexing thereto all relevant documents and making necessary disclosure of facts, that representation may be dealt with and decided on its own merits after hearing all necessary parties, as expeditiously as possible preferably within one month from the date of compliance shown by the petitioner.
