specialization in Food Science and Nutrition. She was appointed only on the recommendation of Screening Committee and not by the Selection Committee. It is not disputed that from the year 2011 onwards, when the respondent No.1 was appointed, she had been allowed to continue in service after grant of periodic extensions. Last extension was granted on July 16, 2021 for a period of three months. Finding that the respondent No.1 is not possessing the requisite minimum qualifications for the post, on October 8, 2021, though other teachers working in the University were granted extension, however, the respondent No.1/petitioner was not granted extension. In the Writ Petition filed by the respondent No.1, interim stay has been granted, even though in identical writ petition filed by similarly situated person bearing Writ-A No.10445 of 2021, titled as Arvind Kumar Sengar v. State of U.P. and others, another learned Single Judge had not granted any relief and the writ petition was dismissed on August 25, 2021. He further submitted that now the selection process in pursuance to the advertisement issued by the University has been completed and even appointment letters have been issued to the selected candidates though on contract basis. On account of interim stay granted by this Court in favour of respondent No.1, selected candidate, who is fully eligible is not able to join service.
